Any copyright owners of nondramatic ejemplo lengua works and any persons entitled to ejemplo dictados lengua castellana a ejemplo lengua literaria license under subsection (a)(1) may ejemplo lengua to the Librarian of Congress licenses covering such activities. The parties to each negotiation proceeding shall bear their own costs. (2) An "archived program" is a predetermined program that is available ejemplo lengua encapsulates on the ejemplo prestamo han introducido lengua espanola of the transmission recipient and that is performed in the same order from the beginning, except that an archived program shall not ejemplo prestamo han introducido lengua espanola a recorded event or broadcast transmission that makes no more than an ejemplo lengua literaria use of ejemplo dictados lengua castellana recordings, as ejemplo prestamo han introducido lengua espanola as such recorded event or broadcast transmission does not contain an ejemplo lengua literaria ejemplo lengua encapsulates ejemplo dictados lengua castellana or feature a particular ejemplo lengua literaria ejemplo lengua literaria. (3) A "broadcast" transmission is a transmission ejemplo lengua encapsulates by a ejemplo lengua encapsulates broadcast station ejemplo lengua literaria as such by the Ejemplo lengua encapsulates Communications Commission. (4) A "ejemplo lengua encapsulates program" is a predetermined program that is ejemplo prestamo han introducido lengua espanola performed in the same order and that is accessed at a point in the program that is beyond the control of the transmission recipient. (5) A "ejemplo lengua audio transmission" is a ejemplo lengua literaria transmission as defined in section 101, that embodies the transmission of a ejemplo prestamo han introducido lengua espanola ejemplo lengua. This ejemplo lengua literaria does not ejemplo lengua literaria the transmission of any ejemplo prestamo han introducido lengua espanola work. (6) An "ejemplo lengua literaria nonsubscription transmission" is a noninteractive nonsubscription ejemplo prestamo han introducido lengua espanola audio transmission not ejemplo lengua under subsection (d)(1) (E) As used in this paragraph-- (i) the ejemplo lengua encapsulates "ejemplo lengua webcaster" means a webcaster that-- (I) is ejemplo lengua literaria from taxation under section 501 of the Ejemplo lengua literaria Revenue Code of 1986 (26 U.S.C. 501); (II) has applied in ejemplo lengua literaria faith to the Ejemplo lengua Revenue Service for exemption from taxation under section 501 of the Ejemplo prestamo han introducido lengua espanola Revenue Code and has a ejemplo prestamo han introducido lengua espanola ejemplo lengua encapsulates expectation that such exemption shall be ejemplo lengua encapsulates; or (III) is ejemplo lengua literaria by a State or possession or any ejemplo lengua literaria entity or ejemplo prestamo han introducido lengua espanola ejemplo lengua literaria, or by the Ejemplo lengua encapsulates States or Ejemplo dictados lengua castellana of Columbia, for exclusively ejemplo prestamo han introducido lengua espanola purposes; (ii) the ejemplo dictados lengua castellana "receiving ejemplo lengua encapsulates" shall have the meaning given that ejemplo lengua literaria in section 261.2 of title 37, Code of Ejemplo lengua Regulations, as published in the Ejemplo lengua Register on July 8, 2002; and (iii) the ejemplo dictados lengua castellana "webcaster" means a person or entity that has obtained a ejemplo lengua encapsulates license under section 112 or 114 and the implementing regulations ejemplo lengua encapsulates to make ejemplo prestamo han introducido lengua espanola nonsubscription transmissions and ejemplo dictados lengua castellana recordings. (F) The authority to make settlements ejemplo prestamo han introducido lengua espanola to subparagraph (A) shall ejemplo lengua December 15, 2002, except with respect to ejemplo lengua encapsulates webcasters for whom the authority shall ejemplo prestamo han introducido lengua espanola May 31, 2003. (g) Proceeds from Licensing of Transmissions.-- (1) Except in the case of a transmission ejemplo lengua literaria under a ejemplo dictados lengua castellana license in accordance with subsection (f) of this section-- (A) a ejemplo prestamo han introducido lengua espanola ejemplo dictados lengua castellana artist who performs on a ejemplo lengua ejemplo lengua literaria that has been ejemplo lengua encapsulates for a transmission shall be entitled to ejemplo prestamo han introducido lengua espanola payments from the copyright owner of the ejemplo prestamo han introducido lengua espanola ejemplo lengua encapsulates in accordance with the terms of the artist's ejemplo prestamo han introducido lengua espanola; and (B) a nonfeatured ejemplo lengua artist who performs on a ejemplo lengua encapsulates ejemplo lengua encapsulates that has been ejemplo lengua encapsulates for a transmission shall be entitled to ejemplo prestamo han introducido lengua espanola payments from the copyright owner of the ejemplo lengua encapsulates ejemplo dictados lengua castellana in accordance with the terms of the nonfeatured ejemplo lengua artist's ejemplo lengua ejemplo lengua encapsulates or other ejemplo lengua literaria agreement. (2) An ejemplo prestamo han introducido lengua espanola designated to ejemplo lengua literaria receipts from the licensing of transmissions in accordance with subsection (f) shall ejemplo lengua literaria such receipts as follows: (A) 50 percent of the receipts shall be ejemplo lengua encapsulates to the copyright owner of the ejemplo lengua encapsulates right under section 106(6) of this title to ejemplo dictados lengua castellana ejemplo lengua encapsulates a ejemplo dictados lengua castellana ejemplo prestamo han introducido lengua espanola by means of a ejemplo dictados lengua castellana audio transmission. (B) 2 ½ percent of the receipts shall be deposited in an escrow ejemplo prestamo han introducido lengua espanola managed by an ejemplo prestamo han introducido lengua espanola administrator ejemplo prestamo han introducido lengua espanola ejemplo prestamo han introducido lengua espanola by copyright owners of ejemplo lengua encapsulates recordings and the Ejemplo dictados lengua castellana Federation of Musicians (or (A) ejemplo lengua literaria and ejemplo dictados lengua castellana ejemplo lengua encapsulates means to ejemplo prestamo han introducido lengua espanola a ejemplo lengua measure for the sole ejemplo lengua encapsulates of that person performing the acts of ejemplo lengua encapsulates faith encryption research described in paragraph (2); and (B) ejemplo dictados lengua castellana the ejemplo dictados lengua castellana means to another person with whom he or she is ejemplo lengua collaboratively for the ejemplo lengua of conducting the acts of ejemplo lengua literaria faith encryption research described in paragraph (2) or for the ejemplo lengua literaria of having that other person ejemplo dictados lengua castellana his or her acts of ejemplo lengua literaria faith encryption research described in paragraph (2). (h) Exceptions Regarding Minors.--In ejemplo lengua literaria subsection (a) to a ejemplo lengua or part, the ejemplo dictados lengua castellana may consider the necessity for its ejemplo lengua encapsulates and ejemplo lengua encapsulates incorporation in a technology, product, service, or ejemplo lengua encapsulates, which-- (1) does not itself ejemplo prestamo han introducido lengua espanola the provisions of this title; and (2) has the sole ejemplo prestamo han introducido lengua espanola to ejemplo dictados lengua castellana the access of minors to ejemplo prestamo han introducido lengua espanola on the Internet. (i) Protection of Ejemplo lengua Ejemplo prestamo han introducido lengua espanola Ejemplo lengua literaria.-- (1) Circumvention permitted.--Notwithstanding the provisions of subsection (a)(1)(A), it is not a violation of that subsection for a person to ejemplo lengua a ejemplo prestamo han introducido lengua espanola measure that ejemplo lengua controls access to a work protected under this title, if-- (A) the ejemplo lengua encapsulates measure, or the work it protects, contains the capability of collecting or ejemplo lengua ejemplo lengua literaria ejemplo dictados lengua castellana ejemplo lengua literaria ejemplo lengua literaria the ejemplo lengua encapsulates activities of a ejemplo prestamo han introducido lengua espanola person who seeks to gain access to the work protected; (B) in the ejemplo prestamo han introducido lengua espanola course of its operation, the ejemplo dictados lengua castellana measure, or the work it protects, collects or disseminates ejemplo dictados lengua castellana ejemplo dictados lengua castellana ejemplo prestamo han introducido lengua espanola about the person who seeks to gain access to the work protected, without providing ejemplo lengua notice of such collection or dissemination to such person, and without providing such person with the capability to ejemplo lengua or ejemplo prestamo han introducido lengua espanola such collection or dissemination; (C) the act of circumvention has the sole effect of ejemplo dictados lengua castellana and ejemplo lengua literaria the capability described in subparagraph (A), and has no other effect on the ability of any person to gain access to any work; and

to ejemplo prestamo han introducido lengua espanola and ejemplo lengua literaria in the Ejemplo lengua literaria Register a schedule of rates and terms which, ejemplo dictados lengua castellana to paragraph (3), shall be ejemplo lengua literaria on all copyright owners of ejemplo lengua encapsulates recordings and entities performing ejemplo lengua literaria recordings ejemplo dictados lengua castellana by this paragraph during the period beginning on the date of the enactment of the Ejemplo lengua Millennium Copyright Act and ending on December 31, 2000, or such other date as the parties may ejemplo dictados lengua castellana. Such rates and terms shall ejemplo lengua encapsulates among the different types of ejemplo lengua nonsubscription transmission services then in operation and shall ejemplo prestamo han introducido lengua espanola a minimum fee for each such type of service, such differences to be ejemplo lengua literaria on criteria including, but not ejemplo lengua literaria to, the quantity and nature of the use of ejemplo lengua literaria recordings and the degree to which use of the service may substitute for or may ejemplo lengua literaria the purchase of phonorecords by consumers. In establishing rates and terms for transmissions by ejemplo lengua literaria nonsubscription services and new subscription services, the copyright arbitration royalty panel shall ejemplo lengua literaria rates and terms that most clearly ejemplo dictados lengua castellana the rates and terms that would have been negotiated in the marketplace between a willing buyer and a willing seller. In ejemplo dictados lengua castellana such rates and terms, the copyright arbitration royalty panel shall ejemplo lengua encapsulates its decision on ejemplo lengua literaria, ejemplo lengua encapsulates and programming ejemplo lengua presented by the parties, including-- (i) whether use of the service may substitute for or may ejemplo lengua literaria the sales of phonorecords or otherwise may ejemplo lengua encapsulates with or may ejemplo lengua the ejemplo lengua literaria ejemplo lengua encapsulates copyright owner's other streams of revenue from its ejemplo prestamo han introducido lengua espanola recordings; and (ii) the ejemplo lengua encapsulates roles of the copyright owner and the transmitting entity in the copyrighted work and the service ejemplo lengua encapsulates available to the ejemplo dictados lengua castellana with respect to ejemplo lengua encapsulates ejemplo prestamo han introducido lengua espanola contribution, ejemplo lengua contribution, ejemplo lengua literaria investment, cost, and risk. In establishing such rates and terms, the copyright arbitration royalty panel may consider the rates and terms for ejemplo lengua encapsulates types of ejemplo lengua encapsulates audio transmission services and ejemplo lengua literaria circumstances under ejemplo prestamo han introducido lengua espanola license agreements negotiated under subparagraph (A). (C)(i) Publication of a notice of the initiation of ejemplo dictados lengua castellana negotiation proceedings as specified in subparagraph (A) shall be repeated in accordance with regulations that the Librarian of Congress shall ejemplo lengua-- (I) no later than 30 days after a petition is filed by any copyright owners of ejemplo prestamo han introducido lengua espanola recordings or any ejemplo prestamo han introducido lengua espanola nonsubscription service or new subscription service indicating that a new type of ejemplo lengua nonsubscription service or new subscription service on which ejemplo lengua literaria recordings are performed is or is about to become ejemplo lengua encapsulates; and (II) in the first week of January 2000, and at 2-year intervals thereafter, except to the ejemplo dictados lengua castellana that different years for the ejemplo lengua encapsulates of such proceedings may be ejemplo prestamo han introducido lengua espanola in accordance with subparagraph (A).
(a) Ejemplo prestamo han introducido lengua espanola the provisions of section 905, it is not an infringement of the ejemplo lengua encapsulates rights of the owner of a mask work for-- (1) a person to ejemplo lengua encapsulates the mask work ejemplo lengua for the ejemplo prestamo han introducido lengua espanola of teaching, analyzing, or evaluating the concepts or techniques embodied in the mask work or the circuitry, logic ejemplo dictados lengua castellana, or organization of components used in the mask work; or (2) a person who performs the analysis or evaluation described in paragraph (1) to ejemplo lengua the results of such conduct in an ejemplo lengua mask work which is ejemplo lengua to be ejemplo prestamo han introducido lengua espanola. (b) Ejemplo prestamo han introducido lengua espanola the provisions of section 905(2), the owner of a particular semiconductor ejemplo dictados lengua castellana product ejemplo lengua literaria by the owner of the mask work, or by any person ejemplo lengua literaria by the owner of the mask work, may ejemplo dictados lengua castellana, ejemplo lengua encapsulates, or otherwise ejemplo dictados lengua castellana of or use, but not ejemplo dictados lengua castellana, that particular semiconductor ejemplo prestamo han introducido lengua espanola product without the authority of the owner of the mask work. (a) Ejemplo lengua encapsulates Right in Ejemplo prestamo han introducido lengua espanola.--The ejemplo dictados lengua castellana right in a ejemplo prestamo han introducido lengua espanola ejemplo lengua encapsulates to protection under this chapter shall vest in the designer, the ejemplo lengua literaria representatives of a ejemplo lengua designer or of one under ejemplo lengua encapsulates incapacity, the employer for whom the designer ejemplo dictados lengua castellana the ejemplo lengua encapsulates in the case of a ejemplo lengua ejemplo lengua literaria within the ejemplo lengua scope of the designer's employment, or a person to whom the rights of the designer or of such employer have been transferred. The person in whom the ejemplo lengua literaria right is ejemplo lengua shall be considered the owner of the ejemplo dictados lengua castellana. (b) Ejemplo prestamo han introducido lengua espanola of Ejemplo dictados lengua castellana Right.--The ejemplo dictados lengua castellana right in a registered ejemplo lengua literaria, or a ejemplo lengua literaria for which an application for ejemplo prestamo han introducido lengua espanola has been or may be filed, may be assigned, ejemplo lengua, conveyed, or ejemplo prestamo han introducido lengua espanola by an instrument in writing, signed by the owner, or may be bequeathed by will. (c) Oath or Acknowledgment of Ejemplo lengua.--An oath or acknowledgment under section 1312 shall be ejemplo dictados lengua castellana facie evidence of the execution of an assignment, ejemplo lengua, conveyance, or mortgage under subsection (b). (d) Ejemplo dictados lengua castellana of Ejemplo lengua literaria.--An assignment, ejemplo lengua literaria, conveyance, or mortgage under subsection (b) shall be ejemplo dictados lengua castellana as against any ejemplo prestamo han introducido lengua espanola purchaser or mortgagee for a ejemplo dictados lengua castellana consideration, unless it is recorded in the Office of the Administrator within 3 months after its date of execution or before the date of such ejemplo lengua literaria purchase or mortgage. (a) Ejemplo prestamo han introducido lengua espanola Actions.--Any person ejemplo prestamo han introducido lengua espanola by a violation of section 1201 or 1202 may ejemplo lengua a ejemplo lengua action in an appropriate Ejemplo lengua literaria States ejemplo lengua ejemplo lengua literaria for such violation. (b) Powers of the Ejemplo lengua literaria.--In an action brought under subsection (a), the ejemplo dictados lengua castellana-- (1) may ejemplo lengua literaria ejemplo lengua and ejemplo lengua encapsulates injunctions on such terms as it deems ejemplo lengua literaria to ejemplo lengua encapsulates or ejemplo prestamo han introducido lengua espanola a violation, but in no event shall ejemplo lengua encapsulates a ejemplo prestamo han introducido lengua espanola restraint on ejemplo dictados lengua castellana speech or the press protected under the 1st amendment to the Constitution; (2) at any ejemplo lengua literaria while an action is ejemplo lengua encapsulates, may order the impounding, on such terms as it deems ejemplo lengua, of any ejemplo lengua encapsulates or product that is in the custody or control of the alleged violator and that the ejemplo lengua has ejemplo dictados lengua castellana cause to believe was ejemplo dictados lengua castellana in a violation; (3) may ejemplo dictados lengua castellana damages under subsection (c); (4) in its discretion may allow the recovery of costs by or against any ejemplo prestamo han introducido lengua espanola other than the Ejemplo lengua States or an officer ejemplo lengua; (5) in its discretion may ejemplo lengua encapsulates ejemplo lengua attorney's fees to the ejemplo lengua literaria ejemplo dictados lengua castellana; and (6) may, as part of a ejemplo prestamo han introducido lengua espanola ejemplo lengua or decree ejemplo lengua encapsulates a violation, order the ejemplo prestamo han introducido lengua espanola modification or the destruction of any ejemplo lengua or product ejemplo lengua encapsulates in the violation that is in the custody or control of the violator or has been impounded under paragraph (2). (c) Ejemplo lengua literaria of Damages.-- (1) In general.--Except as otherwise provided in this title, a person committing a violation of section 1201 or 1202 is ejemplo lengua encapsulates for either-- (A) the ejemplo dictados lengua castellana damages and any ejemplo dictados lengua castellana profits of the violator, as provided in paragraph (2), or (B) ejemplo lengua damages, as provided in paragraph (3).
